MINISTER OF FOREIGN AFFAIRS90914SUMMARYThis enactment amends the Chemical Weapons Convention Implementation Act by deleting the schedule to that Act and the references to that schedule in that Act, in order to avoid potential discrepancies between the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, as amended from time to time, and the portions of that Convention that are reproduced in that schedule.Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:1995, c. 25Chemical Weapons Convention Implementation ActThe definition Convention in subsection 2(1) of the Chemical Weapons Convention Implementation Act is replaced by the following:Convention means the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, signed at Paris, France on January 13, 1993, as amended from time to time pursuant to Article XV of the Convention; (Convention)Chemical Weapons Convention Implementation Act(1) Existing text of the definition:Convention means the Convention on the Prohibition of the Development, Production, Stockpiling and Use of Chemical Weapons and on their Destruction, signed at Paris, France on January 13, 1993, as amended from time to time pursuant to Article XV of the Convention and portions of which are set out in the schedule to this Act; (Convention)Subsection 2(3) of the Act is repealed.Existing text of subsection 2(3):In the event of any inconsistency between the provisions set out in the schedule and the provisions of the Convention, the provisions of the Convention prevail.The schedule to the Act is repealed.
