An Act to amend the Canadian Wheat Board

1. The long title of the Canadian Wheat
Board Act is replaced by the following:
|
|
|
An Act to provide for the constitution and
powers of the Western Canadian Wheat Board
|
|
|
2. Section 1 of the Act is replaced by the
following:
|
|
Short title
|
1. This Act may be cited as the Western
Canadian Wheat Board Act.
|
|
|
3. (1) The definition ``Corporation'' in
subsection 2(1) of the Act is replaced by the
following:
|
|
``Corporation'
' « Commission »
|
``Corporation'' means the Western Canadian
Wheat Board continued by section 3;
|
|
|
(2) The definition ``permit book'' in
subsection 2(1) of the English version of the
Act is replaced by the following:
|
|
``permit
book'' « carnet de livraison »
|
``permit book'' means a Western Canadian
Wheat Board delivery permit issued
pursuant to this Act by the Corporation for
a crop year;
|
|
|
4. The heading of Part I of the Act is
replaced by the following:
|
|
|
THE WESTERN CANADIAN WHEAT BOARD |
|
|
5. Subsection 3(1) of the Act is replaced
by the following:
|
|

3. (1) The Canadian Wheat Board is hereby
continued as the Western Canadian Wheat
Board .

Powers, duties
and functions
|
6. Wherever, under any Act of
Parliament, any instrument made under an
Act of Parliament or any contract, lease,
licence or other document, a power, duty or
function is vested in or exercisable by The
Canadian Wheat Board, that power, duty
or function is vested in or exercisable by the
Western Canadian Wheat Board.

7. Every reference to The Canadian
Wheat Board in any deed, contract or other
document executed by The Canadian
Wheat Board in its own name shall, unless
the context otherwise requires, be read as a
reference to the Western Canadian Wheat
Board.

Rights and
obligations
transferred
|
8. All rights and property of The
Canadian Wheat Board, rights and
property held in its name or held in trust for
it and all its obligations and liabilities are
deemed to be rights, property, obligations
and liabilities of the Western Canadian
Wheat Board.

Continuation
of legal
proceedings
|
9. Any legal proceeding to which The
Canadian Wheat Board is party pending in
any court immediately before the day on
which this section comes into force may be
continued by or against the Western
Canadian Wheat Board in the same
manner and to the same extent as it could
have been continued by or against The
Canadian Wheat Board.

Consequential
amendments
|
10. Unless the context otherwise requires,
``Canadian Wheat Board'', ``The Canadian
Wheat Board'' and ``Canadian Wheat
Board Act'' are respectively replaced by
``Western Canadian Wheat Board'', ``the
Western Canadian Wheat Board'' and
``Western Canadian Wheat Board Act'' in
every Act of Parliament and in every
regulation, as defined in subsection 2(1) of
the Statutory Instruments Act.
