An Act to amend the Canada Labour Code, the
Parliamentary Employment and Staff
Relations Act and the Public Service
Staff Relations Act (prohibited provision
in a collective agreement)

1. The Canada Labour Code is amended
by adding the following after section 55:
|

55.1 (1) A prohibited provision contained in
a collective agreement signed after the
coming into force of this section shall be of no
force or effect.
|

(2) A prohibited provision in a collective
agreement signed before the coming into
force of this section shall be of no force or
effect on or after the day that is two years after
the day on which this section comes into force.
|

Definition of
``prohibited
provision''
|
(3) For the purposes of subsections (1) and
(2), ``prohibited provision'' means a provision
of a collective agreement - excluding a
provision based on the seniority principle -
under which employees hired after a specified
date do not receive the same employee
benefits, wages or conditions of employment
as those received by other employees covered
by the collective agreement.

2. The Parliamentary Employment and
Staff Relations Act is amended by adding the
