Saguenay-St. Lawrence Marine Park Act

64. The definition ``park warden'' in section 2 of the Saguenay-St. Lawrence Marine Park Act is replaced by the following:

``park warden'' means a person appointed under the Parks Canada Agency Act whose duties include the enforcement of this Act or the Canada National Parks Act and who is designated by the Minister as a park warden.

65. Subsection 7(1) of the Act is replaced by the following:

Notice of the proposed change to be tabled and referred to committee

7. (1) A notice of intention to make an order to change boundaries of the park shall be tabled in the House of Commons and stands referred to the committee of the House that normally considers matters relating to parks, or to any other committee designated by the House for the purposes of this section, if the intention is to reduce the area of the park, or of any zone of the park, other than a reduction of the area of a Type III or Type IV zone by one square kilometre or less.

Territorial Lands Act

66. Subsection 3(3) of the Territorial Lands Act is replaced by the following:

(3) Nothing in this Act shall be construed as limiting the operation of the Yukon Quartz Mining Act, the Yukon Placer Mining Act, the Dominion Water Power Act or the Canada National Parks Act.

67. Paragraph 17(2)(a) of the Yukon Placer Mining Act is replaced by the following:

68. (1) Subsection 97(1) of the Mackenzie Valley Resource Management Act is replaced by the following:

National parks and historic sites

97. (1) Subject to paragraph 102(2)(b), this Part does not apply in respect of the use of land or waters or the deposit of waste within a park or park reserve to which the Canada National Parks Act applies or within lands acquired pursuant to the Historic Sites and Monuments Act.

(2) Subsection (1) comes into force on the later of the coming into force of

    (a) section 1 of this Act, and

    (b) Part 4 of the Mackenzie Valley Resource Management Act.

69. (1) Subsection 2.1(1) of the Northwest Territories Waters Act is replaced by the following:

National parks and historic sites

2.1 (1) This Act does not apply in respect of the use of waters or the deposit of waste within a park or park reserve to which the Canada National Parks Act applies, or on any land acquired for the purposes of the Historic Sites and Monuments Act, that is situated within the Mackenzie Valley, as that expression is defined in section 2 of the Mackenzie Valley Resource Management Act.

(2) Subsection (1) comes into force on the later of the coming into force of

    (a) section 1 of this Act, and

    (b) subsection 2.1(1) of the Northwest Territories Waters Act, as enacted by subsection 165(2) of the Mackenzie Valley Resource Management Act, chapter 25 of the Statutes of Canada, 1998.

70. (1) If Bill C-8, introduced in the second session of the thirty-sixth Parliament and entitled An Act respecting marine conservation areas (the ``other Act''), receives royal assent, the definitions ``park'' and ``park reserve'' in section 2 of this Act are replaced by the following:

``park''
« parc »

``park'' means a national park of Canada named and described in Schedule 1.

``park reserve''
« réserve »

``park reserve'' means a national park reserve of Canada named and described in Schedule 2.

(2) Subsection (1) comes into force on the later of the coming into force of the other Act and the coming into force of section 2 of this Act.

70.1 (1) Subsections (2) to (5) apply if Bill C-10, introduced in the second session of the thirty-sixth Parliament and entitled An Act to amend the Municipal Grants Act (the ``other Act''), receives royal assent.

(2) If it is not in force when subsection 3(6) of the other Act comes into force, section 56 of this Act and the heading before it are replaced by the following:

56. Paragraph 2(3)(c) of the Payments in Lieu of Taxes Act is replaced by the following:

    (c) any real property or immovable developed and used as a park and situated within an area defined as ``urban'' by Statistics Canada, as of the most recent census of the population of Canada taken by Statistics Canada, other than national parks of Canada, national marine parks of Canada, national park reserves of Canada, national marine park reserves of Canada, national historic sites of Canada, national battlefields or heritage canals;

(3) Subsection (2) comes into force on the day on which section 56 of this Act comes into force.

(4) If it is not in force when section 56 of this Act comes into force, paragraph 2(3)(c) of the Municipal Grants Act as enacted by subsection 3(6) of the other Act is replaced by the following:

71. (1) Subject to subsections (2) to (4), this Act, other than sections 68 to 70.1, comes into force on a day to be fixed by order of the Governor in Council.

(2) Paragraph 17(1)(b) and the description of Wapusk National Park of Canada in Part 4 of Schedule 1 come into force on a day to be fixed by order of the Governor in Council.

(3) Paragraph 17(1)(c) and the description of Gros Morne National Park of Canada in Part 10 of Schedule 1 come into force on a day to be fixed by order of the Governor in Council.

Coming into force

(4) The description of Aulavik National Park of Canada in Part 12 of Schedule 1 comes into force on a day to be fixed by order of the Governor in Council.
