An Act to amend the Criminal Code and the Department of Health Act (security of the child)

      Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

CRIMINAL CODE

1. Section 43 of the Criminal Code is repealed.

DEPARTMENT OF HEALTH ACT

2. (1) Paragraph 4(2)(a.1) of the Department of Health Act is replaced by the following:

    (a.1) the promotion and preservation of the physical, mental and social well-being of the people of Canada, including, with respect to the children of Canada, the education of Canadians about the health and social risks associated with the corporal punishment of children, the alternatives to its use and the health and social benefits inherent in respecting the right to security of all children;

(2) Paragraph 4(2)(i) of the Act is replaced by the following:

    (i) cooperation with provincial authorities with a view to the coordination of efforts made or proposed for preserving and improving public health, including the coordination of efforts to establish guidelines with respect to the protection of children and law enforcement services for the protection of children.
