192. (1) Subsection 704(1) of the Canada
Shipping Act is replaced by the following:

Appointment
of Adminis- trator
|
704. (1) The Governor in Council shall
appoint an Administrator of the Ship-source
Oil Pollution Fund to hold office for any term,
not exceeding five years, that is fixed by the
Governor in Council.
|
|
Tenure of
office
|
(2) For greater certainty, the person who
holds office as the Administrator of the
Ship-source Oil Pollution Fund
immediately before the coming into force of
subsection (1) continues in office during
good behaviour for the remainder of the
term for which the person was appointed,
but may be removed by the Governor in
Council for cause.

193. (1) Subsection 708(1) of the Act is
replaced by the following:

194. (1) Subsection 4(1) of the Status of the
Artist Act is replaced by the following:

4. (1) The Minister of Canadian Heritage
shall establish a Canadian Council on the
Status of the Artist, composed of seven
part-time members including a Chairperson
and a Vice-chairperson to be appointed by the
Minister and to hold office during pleasure.
|

(2) Subsection 4(4) of the Act is replaced
by the following:
|

Remunera- tion
|
(4) Each Council member shall be paid
reasonable travel and other expenses incurred
while performing the member's duties, and
shall receive such fees for attendance at
Council meetings as the Minister may fix.

|
|
195. (1) Subsection 10(1) of the Act is
replaced by the following:

10. (1) The Canadian Artists and Producers
Professional Relations Tribunal is hereby
established, composed of a Chairperson, a
Vice-chairperson and not less than two or
more than four other members.

(2) Subsection 10(3) of the Act is replaced

|
(2.1) The members of the Tribunal,
including the Chairperson and the
Vice-Chairperson, may be appointed as
full-time or part-time members.

(3) The members of the Tribunal shall be
appointed for a term not exceeding

196. Section 12 of the Act is replaced by
the following:

Remunera- tion and fees
|
12. (1) Each full-time member of the
Tribunal shall be paid such remuneration, and
each part-time member of the Tribunal shall
be paid such fees , as the Governor in Council
may fix.
|
|
Travel and
living
expenses
|
(2) Each member of the Tribunal is entitled
to be paid reasonable travel and living
expenses incurred by the member in the
course of the member's duties in connection
with the work of the Tribunal while absent
from, in the case of a full-time member, the
member's ordinary place of work and, in the
case of a part-time member, the member's
ordinary place of residence.

Retirement
pension
|
(3) The full-time members of the Tribunal
are deemed to be employed in the Public
Service for the purposes of the Public Service
Superannuation Act.
|
|
Compensa- tion
|
(4) The members of the Tribunal are
deemed to be employees for the purposes of
the Government Employees Compensation
Act and to be employed in the public service
of Canada for the purposes of any regulations
made pursuant to section 9 of the Aeronautics
Act.

21. The Director shall not take any action
under subsection 22(1) unless a review
committee established under section 21.1
consents thereto.

Constitution
|
21.1 (1) A review committee is hereby
established consisting of three persons
appointed in accordance with this section.
|
|
Appointment

|
(2) The Director shall appoint one member
of the review committee.

Canadian
Legion
|
(3) The Director shall, by notice, request the
Royal Canadian Legion, or any successor
thereto, to appoint one member of the review
committee within thirty days after receipt of
the request.

|
(4) The two members of the review
committee appointed pursuant to subsections
(2) and (3) shall, within thirty days after the
appointment of the second member, appoint a
third member as the Chairperson of the review
committee.

Appointment
where default
|
(5) Where no member is appointed pursuant
to subsection (3) or no Chairperson is
appointed pursuant to subsection (4), the
Director shall, after consulting with the chief
justice of the province in which the land is
situated, appoint as Chairperson of the review
committee a judge of the superior court of that
province, and, where no member is appointed
pursuant to subsection (3), the Chairperson
shall appoint the member.

Vacancy
|
21.2 (1) Where a vacancy occurs in the
membership of a review committee, the
vacancy shall be filled by appointment in
accordance with section 21.1 for the
appointment of the person in respect of whom
the vacancy arose.
|
|
Notice
|
(2) Forthwith on the establishment of a
review committee, the Director shall notify
the veteran concerned of its establishment and
of the names of its members.
|
|
Allowances
|
21.3 The members of a review committee
are entitled to be paid any daily or other
allowance with respect to the performance of
their duties under this Act that the Minister
may fix.
|
|
Reference
|
21.4 (1) Forthwith on the establishment of
a review committee, the Director shall refer to
the review committee the matter in respect of
which the Director proposes to act under
subsection 22(1) and any action that the
Director proposes to take under that
subsection.
|
|
Review
|
(2) The review committee shall review the
matter and any proposed action referred to it
and
|
|
|
|
|
|
|
|
Procedure
|
(3) A review committee may determine its
own procedure, but shall give the Director and
the veteran concerned a full opportunity to
present evidence and make representations.
|
|
|
