An Act to amend the Members of
Parliament Retiring Allowances Act
|

1. The Members of Parliament Retiring
Allowances Act (``the Act'') is amended by
adding the following, immediately after
section 13:
|
|
Double
payments
prohibited
|
13.1 (1) An allowance or other benefit
payable to a former member under this Act is
not payable to a former member who is
employed by or who is receiving
remuneration from the Government of
Canada, an agency of the Government of
Canada, or a Crown corporation.
|
|
``Crown
corporation'' « société d'État »
|
(2) For the purposes of subsection (1),
``Crown corporation'' has the same meaning
as in section 83 of the Financial
Administration Act.
|
|
Age
restriction
|
13.2 (1) No allowance is payable to a former
member under section 14 or 15 until the
former member has reached sixty years of age.
|
|
Spouse or
child
|
(2) Where a member or former member dies
before reaching sixty years of age, no
allowance is payable to a spouse or child under
section 20 until such time as the member
would have been eligible to be paid an
allowance.

|
Ss. 13.1 and
13.2 not
retroactive
|
13.3 Sections 13.1 and 13.2 apply only to
persons who become former members after
the sections come into force.
|
|
|
2. Section 24 of the Act is repealed and the
following substituted:

24. An allowance under section 20 or a joint
and survivor benefit under subsection 23(4)
|

|
|
|
|
|
|

3. This Act comes into force on the day
that it is assented to.
