SOMMAIRE
SUMMARY
Le texte modifie le Code criminel afin :
a) de définir le terme « bestialité »;
b) d’élargir la portée de l’infraction consistant à encourager le combat ou le harcèlement d’animaux ou d’oiseaux ou à y prêter son concours :
(i) pour y inclure la promotion, l’organisation, la participation ou la réception d’argent relativement au combat ou au harcèlement d’animaux ou d’oiseaux,
(ii) pour que soient aussi visés par l’infraction le dressage, le transport et l’élevage d’animaux ou d’oiseaux à des fins de combat ou de harcèlement de ceux-ci;
c) d’élargir la portée de l’infraction consistant à construire, à fabriquer, à entretenir ou à garder une arène pour les combats de coqs pour viser toute arène pour les combats d’animaux.
This enactment amends the Criminal Code to
(a) define “bestiality”;
(b) expand the scope of the offence of encouraging, aiding or assisting at the fighting or baiting of animals or birds so that the offence
(i) includes promoting, arranging, receiving money for or taking part in the fighting or baiting of animals or birds, and
(ii) also applies with respect to the training, transporting or breeding of animals or birds for fighting or baiting; and
(c) expand the scope of the offence of building, making, maintaining or keeping a cockpit so that the offence applies with respect to any arena for animal fighting.

1 L’article 160 du Code criminel est modifié par adjonction, après le paragraphe (3), de ce qui suit :
1 Section 160 of the Criminal Code is amended by adding the following after subsection (3):

(4) Le tribunal peut, en plus de toute autre peine infligée en vertu de l’un des paragraphes (1) à (3) :
a) rendre une ordonnance interdisant au prévenu, pour la période qu’il estime indiquée, d’être propriétaire d’un animal, d’en avoir la garde ou le contrôle ou d’habiter un lieu où se trouve un animal, la durée de celle-ci étant, en cas de récidive, d’au moins cinq ans;
b) à la demande du procureur général ou d’office, ordonner au prévenu de rembourser à la personne ou à l’organisme qui a pris soin de l’animal les frais raisonnables engagés par suite de la perpétration de l’infraction, si ceux-ci peuvent être facilement déterminables.
(4) The court may, in addition to any other sentence that it may impose under any of subsections (1) to (3),
(a) make an order prohibiting the accused from owning, having the custody or control of or residing in the same premises as an animal during any period that the court considers appropriate but, in the case of a second or subsequent offence, for a minimum of five years; and
(b) on application of the Attorney General or on its own motion, order that the accused pay to a person or an organization that has taken care of an animal as a result of the commission of the offence the reasonable costs that the person or organization incurred in respect of the animal, if the costs are readily ascertainable.

447 (1) Everyone commits an offence who builds, makes, maintains or keeps an arena for animal fighting on premises that he or she owns or occupies, or allows such an arena to be built, made, maintained or kept on such premises.
(2) Le paragraphe 447(3) de la même loi est abrogé.
