This enactment amends the Offshore Health and Safety Act to postpone the repeal of its transitional regulations.

An Act to amend the Offshore Health and Safety Act

Her Majesty, by and with the advice and consent of the Senate and House of Commons of Canada, enacts as follows:

1Subsection 53(5) of the Offshore Health and Safety Act is replaced by the following:

Repeal

(5)Unless repealed on an earlier date, the Canada–Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, the Canada–Newfoundland and Labrador Offshore Marine Installations and Structures Transitional Regulations and the Canada–Newfoundland and Labrador Offshore Area Diving Operations Safety Transitional Regulations are repealed on the expiry of Insertion start eight Insertion end years after the day on which this section comes into force.

2Subsection 92(5) of the Act is replaced by the following:

Repeal

(5)Unless repealed on an earlier date, the Canada–Nova Scotia Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, the Canada–Nova Scotia Offshore Marine Installations and Structures Transitional Regulations and the Canada–Nova Scotia Offshore Area Diving Operations Safety Transitional Regulations are repealed on the expiry of Insertion start eight Insertion end years after the day on which this section comes into force.

Coordinating Amendments

This Act

3If this Act receives royal assent during the period beginning on January 1, 2021 and ending on December 31, 2022, then

  • (a)sections 1 and 2 are deemed not to have come into force and are repealed;

  • (b)the Offshore Health and Safety Act is amended by adding the following after section 53:

    Revival of transitional regulations

    53.‍1(1)The Canada–Newfoundland and Labrador Offshore Marine Installations and Structures Occupational Health and Safety Transitional Regulations, the Canada–Newfoundland and Labrador Offshore Marine Installations and Structures Transitional Regulations and the Canada–Newfoundland and Labrador Offshore Area Diving Operations Safety Transitional Regulations, as they read immediately before they were repealed on December 31, 2020, are revived on January 1, 2021.

    Repeal

    (2)The regulations that are revived under subsection (1) are repealed on December 31, 2022, unless they are repealed on an earlier date following their revival under this section.

    Offences

    (3)No person shall be convicted of an offence under a provision of a regulation revived under subsection (1) if the offence was committed during the period beginning on January 1, 2021 and ending on the day before the day on which this section comes into force.

  • (c)the Act is amended by adding the following after section 92:

    Repeal

    (2)The regulations that are revived under subsection (1) are repealed on December 31, 2022, unless they are repealed on an earlier date following their revival under this section.
