The Standing Joint Committee for the Scrutiny of Regulations met this day at 8:30 a.m., in room 256-S, Centre Block, the joint chairs, the Honourable Senator Pana Merchant and Mr. Harold Albrecht, presiding.

Members of the committee present: The Honourable Senators Merchant, Moore, Omidvar and Runciman (4).

Representing the House of Commons: Harold Albrecht, Gary Anandasangaree, John Brassard, Nicola Di Iorio, Kerry Diotte, Pierre-Luc Dusseault, Ali Ehsassi, Fayçal El-Khoury, Garnett Genuis, Bernadette Jordan, Marco Mendicino, and Salma Zahid (12).

Also present: Jean-Marie David, Joint Clerk of the Committee (House of Commons), Evelyne Borkowski-Parent, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Service, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

Mr. Pellerin made a statement and, together with Mr. Meredith, answered questions.

At 9:50 a.m., the committee suspended.

At 9:52 a.m., the committee resumed.

In the matter of SOR/2002-309 — Agricultural Products Marketing Act Administrative Review, it was agreed that the joint chairs invite the Deputy Minister of Agriculture and Agri-Food Canada to appear before the committee.

In the matter of SI/2016-26 — Order Approving Interim Order No. 4 Respecting Flight Deck Occupants, it was agreed that the joint chairs correspond with the Minister of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2014-112 — Regulations Amending the Weights and Measures Regulations (Administrative Monetary Penalties), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Innovation, Science and Economic Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-227 — Immigration and Refugee Protection Regulations; SOR/2003-197 —- Regulations Amending the Immigration and Refugee Protection Regulations; SOR/2003-260 — Regulations Amending the Immigration and Refugee Protection Regulations; SOR/2003-383 — Regulations Amending the Immigration and Refugee Protection Regulations; SOR/2004-59 — Regulations Amending the Immigration and Refugee Protection Regulations; SOR/2004-111 — Regulations Amending the Immigration and Refugee Protection Regulations; SOR/2004-167 — Regulations Amending the Immigration and Refugee Protection Regulations; SOR/ 2004-217 — Regulations Amending the Immigration and Refugee Protection Regulations; and SOR/2005-61 — Regulations Amending the Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officers of Canada Border Services Agency and Immigration, Refugees and Citizenship Canada with respect to certain comments made by the committee.
