The Standing Joint Committee for the Scrutiny of Regulations met at 8:30 a.m., this day, in room 256-S, Centre Block, the joint chairs, the Honourable Senator Bob Runciman and Ms. Chris Charlton, presiding.

Representing the Senate: The Honourable Senators Bellemare, Braley, Harb, Moore and Runciman (5).

Representing the House of Commons: Rob Anders, Paulina Ayala, Patrick Brown, Chris Charlton, Réjean Genest, Brian Masse, Massimo Pacetti, Andrew Saxton, Mark Strahl, Maurice Vellacott and Wai Young (11).

Associate member present for the House of Commons: Patricia Davidson for Garry Breitkreuz (1).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/2011-281 — Regulations Amending the Food and Drug Regulations (1618 — Food Additive), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/92-631 — Vinyl Chloride Release Regulations, 1992, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2007-229 — Regulations Amending the Canadian Aviation Regulations (Part IV), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2001-390 — Form of Proxy (Banks and Bank Holding Companies) Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-140 — Regulations Amending Certain Regulations Made Under the Canada National Parks Act (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Parks Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-175 — Regulations Amending the Reporting of Imported Goods Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2005-383 — Regulations Amending the Accounting for Imported Goods and Payments of Duties Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/95-500 — Power Line Crossing Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2003-39 — National Energy Board Processing Plant Regulations, it was agreed that the file be closed.

In the matter of SOR/2005-190 — Regulations Amending the Agriculture and Agri-Food Administrative Monetary Penalties Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of DORS/2006-102 — Traffic on the Land Side of Airports Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-261 — Cribs, Cradles and Bassinets Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of Canadian Food Inspection Agency Fees Notices, as amended to March 30, 2002, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of C.R.C. c. 1238 — Northwest Territories Reindeer Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Indian and Northern Affairs Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-164 — National Capital Commission Animal Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the National Capital Commission with respect to certain comments made by the committee.

In the matter of SOR/2001-32 — Controlled Goods Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Public Works and Government Services Canada with respect to certain comments made by the committee.

In the matter of SOR/2011-109 — Regulations Amending the Canada Industrial Relations Board Regulations, 2001, it was agreed that the file be closed.

In the matter of SOR/2011-217 — Regulations Amending the National Historic Parks General Regulations (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2006-327 — Order Amending the Schedule to the Customs Tariff, 2006-4 (Textiles and Apparel), it was agreed that the file be closed.

In the matter of SOR/2012-259 — Order Amending the Schedule to the Customs Tariff (Harmonized System Conversion, 2012-2), it was agreed that the file be closed.
