The Standing Joint Committee for the Scrutiny of Regulations met at 8:42 a.m., this day, in room 256-S, Centre Block, the Honourable Yonah Martin and Mr. Andrew Kania, Joint Chairs, presiding.

Representing the Senate: The Honourable Senators Boisvenu, Harb, Hervieux-Payette, P.C., Housakos, Martin, Moore and Wallace (7).

Representing the House of Commons: Harold Albrecht, Gérard Asselin, Ray Boughen, Dona Cadman, Christiane Gagnon, Andrew Kania and Paul Szabo (7).

Acting members present for the House of Commons: Olivia Chow for Brian Masse; Deepak Obhrai for Scott Armstrong, Sylvie Boucher for Royal Galipeau (3).

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of SOR/98-166 — Regulations Amending Patented Medicines (Notice of Compliance), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Industry Canada with respect to certain comments made by the committee.

In the matter of SOR/2001-184 — Regulations Amending and Repealing Certain Regulations Administered and Enforced by the Canadian Food Inspection Agency, 2000-1 (Miscellaneous Program), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Canadian Food Inspection Agency with respect to certain comments made by the committee.

In the matter of SOR/96-143 — Veterinary Drug Evaluation Fees Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee and that Health Canada's response, once received, be forwarded to the Subcommittee on Agenda and Procedure for preparation of a recommendation to the full committee.

In the matter of SOR/98-159 — Motor Vehicle Restraint Systems and Booster Cushions Safety Regulations, it was agreed that the joint chairs correspond with the Minister of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-346 — Canadian Payments Association By-law No. 3 — Payment Items and Automated Clearing Settlement System, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada and the Department of Justice Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-197 — Storage Tank Systems for Petroleum Products and Allied Petroleum Products Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/99-467 — Canada Travelling Exhibitions Indemnification Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Canadian Heritage with respect to certain comments made by the committee.

In the matter of SOR/2006-148 — Regulations Amending the Reporting of Imported Goods Regulations; and SOR/2006-1 — Regulations Amending the Reporting of Imported Goods Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Canada Border Services Agency with respect to certain comments made by the committee.

In the matter of SOR/2001-520 — Canada Industrial Relations Board Regulations, 2001, it was agreed that the file be closed.

In the matter of SOR/92-620 — Corrections and Conditional Release Regulations; and SOR/96-108 — Corrections and Conditional Release Regulations, amendment, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Public Safety Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-174 — Canadian Payments Association By-law No. 1 — General, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-175 — Canadian Payments Association By-law No. 2 — Finance, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-347 — Canadian Payments Association By-law No. 6 — Compliance, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Department of Finance Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-151 — Regulations Amending the Pacific Pilotage Tariff Regulations (Additional Charges), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/92-631 — Vinyl Chloride Release Regulations, 1992, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Environment Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-219 — Passenger Information (Customs) Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2003-355 — Off-Road Small Spark-Ignition Engine Emission Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2006-241 — Regulations Amending the Food and Drug Regulations (Data Protection), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2008-80 — Regulations Amending the Laurentian Pilotage Authority Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2009-110 — Glass Doors and Enclosures Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Health Canada with respect to certain comments made by the committee.

In the matter of SOR/2010-14 — Order 2010-87-01-01 Amending the Domestic Substances List; and SOR/2009-39 — Order 2008-87-12-01 Amending the Domestic Substances List, it was agreed that the files be closed.

In the matter of SOR/2009-329 — Regulations Amending the Pacific Pilotage Regulations, it was agreed that the file be closed.

In the matter of SOR/2010-26 — Regulations Amending the Canadian Aviation Regulations (Parts I and IV), it was agreed that the file be closed.

In the matter of SOR/2010-38 — Regulations Amending the Controlled Products Regulations, it was agreed that the file be closed.
