The Standing Joint Committee for the Scrutiny of Regulations met at 8:32 a.m., this day, in room 256-S, Centre Block, the Honourable J. Trevor Eyton and Mr. Derek Lee, Joint Chairs, presiding.

Representing the Senate: The Honourable Senators Bryden, Eyton, Harb, Moore and Zimmer (5).

Representing the House of Commons: Gérard Asselin, David Christopherson, Carole Freeman, Luc Harvey, Rahim Jaffer, Derek Lee, Rick Norlock, Paul Szabo and Tom Wappel (9).

Other members present: Dean Del Mastro.

Also present: Mike MacPherson, Joint Clerk of the Committee (House of Commons); Peter Bernhardt, General Counsel, and Shawn Abel, Counsel, Parliamentary Information and Research Services, Library of Parliament.

In attendance: The official reporters of the Senate.

The committee proceeded to consider its permanent order of reference, as set out in section 19, the Statutory Instruments Act, R.S.C., 1985, c. S-22, which provides for the following:

Every statutory instrument issued, made or established after December 31, 1971, other than an instrument the inspection of which and the obtaining of copies of which are precluded by any regulations made pursuant to paragraph 20(d), shall stand permanently referred to any committee of the House of Commons, of the Senate or of both Houses of Parliament that may be established for the purpose of reviewing and scrutinizing statutory instruments.

In the matter of Report No. 81 (Third Report of the Standing Joint Committee for the Scrutiny of Regulations), regarding the Species at Risk Act, it was agreed that the report be adopted.

In the matter of Report No. 82 (Fourth Report of the Standing Joint Committee for the Scrutiny of Regulations), regarding the Indian Act, it was agreed that the report be adopted.

In the matter of SI/2005-2 — Order Giving Notice of Decisions not to add Certain Species to the List of Endangered Species, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2005-317 — Regulations Amending the Employment Insurance Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2005-369 — Regulations Amending the Employment Insurance Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-393 — Regulations Amending the Employment Insurance Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Human Resources and Social Development Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-227 — Immigration and Refugee Protection Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Citizenship and Immigration Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-346 — Regulations Amending the Laurentian Pilotage Authority Regulations, it was agreed that the joint chairs correspond with the Minister of Transport Canada with respect to certain comments made by the committee.

In the matter of SOR/2002-421 — Canadian Forces Employment Equity Regulations, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Treasury Board of Canada Secretariat with respect to certain comments made by the committee.

In the matter of SOR/86-236 — Statistics Canada Fees Order, No. 1, it was agreed that counsel to the committee correspond with the Designated Instruments Officer of Statistics Canada with respect to certain comments made by the committee.

In the matter of SOR/2003-173 — Regulations Amending the Medical Devices Regulations (1293 — Quality Systems), it was agreed that counsel to the committee correspond with the Designated Instruments Officer of the Policy Development Directorate, Health Canada, with respect to certain comments made by the committee.

In the matter of SOR/2001-179 — Regulations Amending the Life Saving Equipment Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SI/2007-65 — Order Repealing the Canada Shipping Act and Fixing July 1, 2007 as the Date of the Coming into Force of Certain Sections of the Canada Shipping Act, 2001, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SI/2007-99 — Certain Former Employees of SDL Optics, Inc. Remission Order, it was agreed that the file be closed.

In the matter of SOR/2006-96 — Regulations Amending the Firearms Fees Regulations, it was agreed that the file be closed.

In the matter of SOR/96-400 — Canada Occupational Safety and Health Regulations, amendment, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/99-144 — St. Lawrence Seaway Authority Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/98-230 — Portions of the Department of National Defence Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/98-231 — Portions of the Department of Public Works and Government Services Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/98-232 — Regulations Amending the Airport Transfer Regulations, it was agreed that the file be closed.

In the matter of SOR/99-247 — Portions of the Royal Canadian Mounted Police Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/2000-1 — Certain Canada Port Authorities Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/2000-60 — Portions of the Canada Ports Corporation Divestiture Regulations, it was agreed that the file be closed.

In the matter of SOR/2002-18 — Regulations Amending the competency of Operators of Pleasure Craft Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2004-263 — Regulations Amending Certain Regulations Made under the Fisheries Act (Miscellaneous Program), it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/99-256 — Canada Cooperatives Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2001-513 — Regulations Amending the Canada Cooperatives Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2003-458 — Regulations Amending the Broadcasting Distribution Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.

In the matter of SOR/2007-89 — Regulations Amending the Electricity and Gas Inspection Regulations, it was agreed that counsel to the committee review their status at a later date and inform the committee of the action taken.
