PARK RESERVES

Application of Act to reserves

40. Subject to sections 41 and 42, this Act applies to a park reserve as if it were a park.

Aboriginal resource harvesting

41. The application of this Act to a park reserve is subject to the carrying on of traditional renewable resource harvesting activities by aboriginal persons.

Agreement re Gwaii Haanas

42. (1) The Governor in Council may authorize the Minister to enter into an agreement with the Council of the Haida Nation respecting the management and operation of Gwaii Haanas National Park Reserve.

Resource harvesting and cultural activities

(2) For the purpose of implementing an agreement referred to in subsection (1), the Governor in Council may make regulations, applicable in the Gwaii Haanas National Park Reserve, respecting the continuance of traditional renewable resource harvesting activities and Haida cultural activities by people of the Haida Nation to whom subsection 35(1) of the Constitution Act, 1982 applies.

Additions to reserve

(3) Pending the resolution of the disputes outstanding between the Haida Nation and the Government of Canada respecting their rights, titles and interests in or to the Gwaii Haanas Archipelago, the Governor in Council may, by order, alter the description of Gwaii Haanas National Park Reserve in Schedule 2 for the purpose of adding to the Reserve any portion of the Gwaii Haanas Archipelago as described in Schedule VI to the National Parks Act, chapter N-14 of the Revised Statutes of Canada, 1985, as that Act read immediately before its repeal.

(4) Section 7 does not apply in relation to the enlargement of Gwaii Haanas National Park Reserve in accordance with subsection (3).

NATIONAL HISTORIC SITES

Lands set apart

43. (1) The Governor in Council may set apart any land, the title to which is vested in Her Majesty in right of Canada, as a national historic site to which this Act applies in order to

    (a) commemorate a historic event of national importance; or

    (b) preserve a historic landmark, or any object of historic, prehistoric or scientific interest, that is of national importance.

Changes to boundaries

(2) The Governor in Council may make any changes that the Governor in Council considers appropriate in areas set apart under subsection (1).

Application of this Act

(3) The Governor in Council may, by order, extend the application of any of the following provisions to national historic sites:

    (a) sections 8, 12, 16 and 18 to 33; and

    (b) subsections 11(1) and (2), except as they relate to zoning.

44. An Act to amend the National Parks Act, chapter 11 of the Statutes of Canada, 1974, is repealed.

Repeal

45. An Act to establish a National Park on the Mingan Archipelago, chapter 34 of the Statutes of Canada, 1984, is repealed.

Repeal

46. An Act to amend the National Parks Act and to amend An Act to amend the National Parks Act, chapter 48 of the Statutes of Canada, 1988, is repealed.

Repeal of R.S., c. N-14

47. The National Parks Act is repealed.

48. Section 8 of the schedule to the Contraventions Act and the heading before it are repealed.

49. Section 9 of Schedule III to An Act to amend the Financial Administration Act and other Acts in consequence thereof, chapter 24 of the Statutes of Canada, 1991, and the heading before it are repealed.

Parks Canada Agency Act

50. The definitions ``national historic site'' and ``national park'' in section 2 of the Parks Canada Agency Act are replaced by the following:

``national historic site''
« lieu historique national »

``national historic site'' means a place designated under subsection (2) or a national historic site to which the National Parks Act applies.

``national park''
« parc national »

``national park'' means a park or park reserve as defined in section 2 of the National Parks Act.

CONDITIONAL AMENDMENTS

51. (1) On the later of the coming into force of section 55 of the Parks Canada Agency Act, chapter 31 of the Statutes of Canada, 1998, and the coming into force of section 47 of this Act, the definition ``superintendent'' in section 2 of this Act is replaced by the following:

``superintendent'' means a person appointed under the Parks Canada Agency Act who holds the office of superintendent of a park or of a national historic site to which this Act applies, and includes any other person appointed under that Act who is authorized by that person to act on that person's behalf.

(2) On the later of the coming into force of section 55 of the Parks Canada Agency Act, chapter 31 of the Statutes of Canada, 1998, and the coming into force of section 47 of this Act, section 19 of this Act is replaced by the following:

Designation of park wardens

19. The Minister may designate persons appointed under the Parks Canada Agency Act whose duties include the enforcement of this Act to be park wardens for the enforcement of this Act and the regulations in any part of Canada and the preservation and maintenance of the public peace in parks, and for those purposes park wardens are peace officers within the meaning of the Criminal Code.

(3) If section 47 of this Act comes into force before section 55 of the Parks Canada Agency Act, chapter 31 of the Statutes of Canada, 1998, section 55 of that Act is repealed.

(4) If section 47 of this Act comes into force before section 56 of the Parks Canada Agency Act, chapter 31 of the Statutes of Canada, 1998,

    (a) section 56 of that Act is repealed; and

    (b) section 45 of that Act is replaced by the following:

Designation under National Parks Act

45. Any person who, or any person within a class of persons that, was designated by the Minister under subsection 5(2.1) of the National Parks Act, chapter N-14 of the Revised Statutes of Canada, 1985, before the coming into force of section 20 of An Act respecting national parks, enacted in the first session of the thirty-sixth Parliament, and who, immediately after the coming into force of that section, is an employee is deemed to have been designated under that section.

52. If Bill C-48, introduced in the first session of the thirty-sixth Parliament and entitled An Act respecting marine conservation areas, is assented to, then, on the later of the coming into force of that Act and the coming into force of section 2 of this Act, the definitions ``park'' and ``park reserve'' in section 2 of this Act are replaced by the following:

``park reserve'' means a national park reserve named and described in Schedule 2.

COMING INTO FORCE

Coming into force

53. (1) Subject to subsections (2) to (4), this Act comes into force on a day to be fixed by order of the Governor in Council.

(2) Paragraph 18(1)(b) and the description of Wapusk National Park in Part 4 of Schedule 1 come into force on a day to be fixed by order of the Governor in Council.

(3) Paragraph 18(1)(c) and the description of Gros Morne National Park in Part 10 of Schedule 1 come into force on a day to be fixed by order of the Governor in Council.

Coming into force

(4) The description of Aulavik National Park in Part 12 of Schedule 1 comes into force on a day to be fixed by order of the Governor in Council.
